By registering for a course at ELAS UK Ltd (the College) students accept the following terms and conditions of the College:
|
Compliance with the UKBA
All students must comply with UKBA regulations. This includes student attendance, updating the College on contact details, and abiding by the terms of your visa. Further information is contained within the Student Attendance Policy and Change of Contact Details Procedure. These policies are explained in detail during the student induction.

Enrolment, Tuition Fees and Registration Fee |
|
Students must be 16 years of age or over. All fees due to the College must be paid, in full, prior to the commencement of the courses. Failure to pay the full amount prior to commencement of the course will result in cancellation of your place on the course, non refund of fees, and we will give notification to the UK Border Agency. Tuition fees do not include; travel, accommodation, accommodation search fee, social programmes, external examination fees, personal and health insurance, bank charges on international money transfers or course books and materials. There is no reduction or refund in fees where a course includes a public holiday or College holiday. For public holiday dates see www.bankholidaydates.co.uk. If a student is on a short course of less than 10 weeks then courses can be extended to cover Easter and Christmas breaks. As well as the agreed course fees, students need to pay the registration fee. This is a non-refundable payment of £300 in all cases.

Course Bookings |
The College reserves the right to offer admissions or reject applicants as it deems appropriate, in line with course entry requirements and the responsibilities placed on the College by the UKBA. Accordingly, the College may ask applicants to provide additional information where necessary. Courses will not be delayed/extended due to any unauthorized absences and/or uncertified illness. Please note that you can only change class/course if there is a space in the class into which you wish to transfer and authorisation is given from the UKBA. If a student fails to start on the commencement date or leaves the course prior to the completion of the course, the student’s name will be removed from the class register without any refund or replacement in another class. The UKBA will also be informed. The College reserves the right to change any teacher, class time and/ or room and to combine classes if necessary. It is the responsibility of the student to book a course sufficiently in advance, in order to complete all visa requirements. No extension to course bookings will be given if formalities are not completed in time.

Same gender based tuition |
Research has shown students perform at the best in classes with the same gender. ELAS UK strives to keep itself up to date with the new technology, research and development in the field of education. Based upon this the college will run separate classes for male and female students.

English Test |
Students will be given a telephone English test prior to receiving a CAS. If your English level is below level B1, no CAS will be issued.
|
Visa Refusal |
Upon a visa refusal, if the student is awarded the full 30 points for the CAS issued by the college then a refund of fees minus £1,500 will be paid to the student. This is due to the administrative cost and loss incurred by the college in processing the CAS and related tasks.
If the student is refused a visa and does not get the 30 points due to a mistake in the process of issuing the CAS, then the college will only retain the £300 registration fee, and the remainder will be refunded.
For local students who are refused when applying for their visa extension there will be no refund of fees until there is clear evidence that the student has returned to his country of origin. If the student returns to his home country, then the college will retain £1000 and refund the remainder. The refund will made within the first 3 months of the visa extension refusal once to student has supplied evidence of his/her return. |
Refunds |
ELAS UK makes every attempt to keep to arrangements outlined in the course brochure. However, we reserve the right to alter the programme as may be necessary for reasons of safety, weather, travel arrangements or other factors arising beyond our control. In the unlikely event of license suspension by the UKBA, courses will continue as normal, however no new CAS’s can be issued. If the license is withdrawn, no refund of fees will be given. However in the case of the latter, if you have less than six months on your visa, you will be allowed to stay until the visa expires. However if you have more than six months left on your visa, your stay will be limited to 60 days. We reserve the right to change courses or cancel courses due to insufficient bookings. In the event of insufficient bookings, you will be placed on an alternative (and similar) course. If this subsequent course has insufficient bookings, we reserve the right to cancel the course and a full refund for course fees only will be given directly to your new college. If you choose to leave the country then the refund will be paid directly to you. In addition, the UKBA will be informed. When all monies are repaid our liability shall wholly cease. If the full payment for the course is made less than 30 days before the start date, the booking is not secured and ELAS UK reserves the right to cancel the booking. If full payment is made 30 days or more before the start date, and ELAS UK gives at least 30 days notice for cancellation of course, then the student must accept the alternative course. If they choose not to accept it, no refund will be given. If full payment is made 30 days or more before the start date, and ELAS UK gives less than 30 days notice for cancellation of a course, then the student will be given a refund minus the administration fee.
If during enrolment we discover that the student does not have the level of knowledge and/or skills required to undertake the course yet the student’s entrance qualifications suggested he had the necessary requirements, then student must follow any access course or remedial course that may be required
Refunds will not be given in the following situations:
- If a student is dismissed for poor attendance or gross misconduct.
- If any fraud is detected in the process of applying for the visa
- If the visa is refused on the basis of a previous visa refusal
- If a student arrives in the UK and decides to change college
- If the student decides to defer their course
- If the student is refused entry into the UK when he first arrives for the course.
- If a student is refused re-entry to the UK if they leave the country during the course.
- If the student changes course within the college, the fees paid will be transferred to the new course. The student will have to pay the remaining balance if the new course fees are higher than the old course fees. No refund will be given where the new course involves lower fees. Only in exceptional cases, at the discretion of the Directors, will a student be allowed to change college. In this case, the refund will only be paid directly to the new college and the student will be charged a £1500 cancellation fee.
Refunds are only made by cheque or bank transfer. Any bank charges must be paid by the student. All refunds will take approximately eight weeks from the date all original documents required by the College are received. |
Late Enrolment |
If a student fails to enrol 15 days after the date of arrival in the UK, a late enrolment fee of £150 will be charged.

Attendance |
If student’s attendance (excluding authorized holidays) falls below 80%, their name will be removed from the class register and they will not be allowed to continue their studies. The relevant authorities and sponsoring bodies (UKBA/SACB) are always informed in such cases. If authorised absences are so numerous as to warrant the student unable to successfully continue the course, the college will withdraw sponsorship.

Insurance |
It is advisable for all students at ELAS UK to have valid insurance cover for the duration of their course, from arrival until departure.

Accommodation Fees and Accommodation Cancellation |
Accommodation fees are only valid for the person and dates specified. There is a £150 accommodation arrangement fee. Students will enter and sign accommodation contracts with landlords and letting agents and abide by the contract. ELAS UK has no involvement with student accommodation outside searching for suitable accommodation on the student’s request. The minimum accommodation search made by ELAS UK is for a 6 month contract. Accommodation fees are non transferable, non refundable and non changeable. Full payment for accommodation booking must be received in advance to secure a place. In the case of visa refusal or cancellation, we will not be able to refund the accommodation fee. |
Discipline |
All students are expected to behave in an orderly manner. Students will be held personally responsible for rectifying any wilful damage to College property or personnel in the case of such misconduct. In the case of flagrant misconduct or proven criminal offence we reserve the right to expel any student. Flagrant misconduct includes, but is not restricted to; verbal or physical abuse of staff or students, lying about the reasons for non-attendance, students will be required to pay for any damage they cause to the premises and/or property of the College, or property in the care of the College, or their accommodation arranged by the College. Students will be required to pay any charges incurred by them including deliberate damage to the Colleges resources, theft from the college, or from other students/staff. In the event of such expulsion no refund of fees will be made and they will remain liable for any extra fees and charges, including the provision of false or forged documentation in their application, or any conduct that interferes with the well-being of other students, staff or the reputation of the College, or which interferes with the college’s ability to meet its obligations to UKBA or other relevant bodies.

Force Majeure |
The College is not be deemed in default of its obligations to the extent that performance of its obligations or attempts to cure any breach are delayed, restricted, or prevented by reason of any act of God or by the government, fire, natural disaster, strike, insufficient demand for classes, the failure of necessary power systems/connections, or any other act or condition beyond the reasonable control of the School, provided that ELAS uses its best efforts to avoid or remove the causes of non-performance and continues performance immediately after those causes are removed. |
Medical Matters |
Students should advise the person responsible for Student Welfare of any medication they are currently taking and inform ELAS UK staff of any medical conditions which might preclude them from participating in specific activities. Students should ensure they have adequate travel insurance to cover any medical emergencies that may occur. If you need hospitalization, you will be treated at a NHS hospital, but again you must ensure you have adequate insurance to cover any medical expenses. |
Liability |
The College is fully insured with Public Liability Insurance. Students are advised that the College, its employees and its representatives accept no responsibility for personal injury and/or loss of/damage to personal property on the College premises, whether by fire, burglary, theft or otherwise. This condition also applies to public and private places when students are on College trips/excursions. The College is not responsible for the safekeeping or delivery of any fax, post etc sent to students at the College addresses. Nor is the College responsible for the safekeeping of exam results or certificates. The college takes no responsibility for loss or damage of any personal belongings, or for any damages or accidents caused through negligence or otherwise of a third party.

Change of Details |
The college will keep student records on its computerised database. It is the student’s responsibility to keep us informed of all changes in personal circumstances, in particular: Change of telephone number, E-mail address, residential address in the UK and/or the student’s home country. Changes to next of kin contact details (contact name, telephone numbers for emergencies). |
Advertisements, brochures and website |
The College reserves the right to alter dates, fees and any particulars in published material (in prospectus, brochures, or on the website) without prior notice. The College also reserves the right to vary, amend or introduce regulations, terms, policies and procedures without prior notice, within reason. This does not affect students’ statutory rights. |
Recovery of outstanding fees |
The College reserves the right to contract any third party to provide services, including enforcing any terms of this agreement, and to store and share with any parties as appropriate, students’ personal information. The College reserves the right to initiate the recovery of all outstanding fees or College property from the students, such recovery may require legal action as appropriate. The college will not pay any charges incurred by the student from debt recovery agents. The recovery will include fees owed from expelled students |
Extra charges |
The College reserves the right to make the following charges, at the rates detailed on student notice boards which are updated from time to time;
- Instalment payments.
- Administrative charges
- Late payment penalty charges. Administrative charges for costs of dealing with missing payments, such as dishonoured cheques.
- Administrative charges for refunds.
- Transfer charges for students who have already arrived in the UK and who defer their studies to a later session of their course or to another course starting at a later session.
- Accommodation charges including non-refundable deposit of four weeks rent on accommodation arranged by the college in advance at the student’s request.
- Late submission penalties, assessment re-takes and any other such charges for additional work incurred by academic staff due to the failure of the student to meet course requirements.

General |
All documents provided by students must be originals. Where the original documents cannot be sent, notarised copies or copies attested by the issuing authority are acceptable. The documentation required must be clear, legible and where necessary translated into English language by an approved translator/translating body.
Students may from time to time be photographed, the photographs of which may be used in the College’s promotional/publicity material. The College reserves the right to all photographs which may be used in any way the College sees appropriate in promoting itself. The copyright to all photographs shall belong to ELAS UK LTD. The College building has facilities for people who use wheelchairs on the ground floor only. There is no disabled toilet. It is the policy of the College not to disclose any personal details of any students to a third party, other than to the appropriate authorities, without the prior written authority of students previously and currently enrolled. These Terms are governed by the law of England and are subject to the exclusive jurisdiction of the Courts of England.
Students are advised that the full College regulations, procedures and policies are available upon request.
